Join the Coast Guard Auxiliary. Our basic contact information is that we are in Division 11 of the Coast Guard Auxiliary and meet at the Ryan Visitors Center (across the street from the marina in Floyd Bennett Field) on the First Wednesday of each month, our Division now has 4 Flotillas and you can contact Tom Matonti who is in 11-09 which meets on the Second Tuesday of each month also at the RVC, and 11-02 and 11-01 meet on the Third Thursday of each month if you want to see some people. Landmark Decision affecting all boaters in the State of New York

In a written reply to the Deep Creek Yacht Club of Brooklyn, NY, the New York State Dept. of Environmental Conservation agreed with the Club’s position regarding the application of antifouling bottom paint on boat owner’s boats. The NYSDEC has been issuing pamphlets claiming that private recreational boats owners needed to own or lease the property that their boats were on in order for them to legally apply antifouling bottom paint. Antifouling bottom paint is an “unclassified pesticide” according to NY State laws. There are over half a million registered boats in New York State that are affected by these regulations The Club’s argument was that there was nothing in NY State law that supported such a position. Marina’s and other boat storage yards often cited these regulations to prevent boat owners from painting their own boats. Although this may have been a profitable business decision, the law is not in their favor. The NYSDEC wrote that only written approval is needed to paint their own boat. Such approvals are usually written into standard storage contracts. “We believed the NYSDEC erred under NY State pesticide laws when they issued their directives”, said Bill Woodroffe, Commodore of the Club. “Marina’s and storage yards still have the prerogative to allow the various types of work boaters may do on their own boat but they can not cite this DEC regulation to arbitrarily ban bottom painting by boat owners. Boaters choose their boat storage area based on price and services offered. The ability and convenience to do one’s own work while on the hard is usually high on their list of priorities.” The Deep Creek YC investigated this issue after marina’s cited this “law” and barred boat owners from painting their own boats. The issue is not about environmental protection as the methods used by the marina and boat owners to paint the bottom are identical. In many ways the boat owners are more careful in applying this paint. It does, however, put to rest the misunderstanding about these regulations. _________________ Commodore, DCYC

Before you empty your bilge think about the consequences. "The Federal Water Pollution Control Act prohibits the discharge of oil or oily waste into or upon the navigable waters and contiguous zone of the United States. If such discharge causes a film or sheen upon or discoloration of, the surface of the water, or cause a sludge or emulsion beneath the surface of the water. Violators are subject to a penalty of $5000."

April 1. 2002 Boaters Take Clean Water Initiative

Barren Island, Brooklyn NY - It only seems natural that users of a National Recreation Area regard their environment as special. That is the way boaters of the Deep Creek Yacht Club, based at Gateway Marina in Gateway National Recreation Area, view the waters around Jamaica Bay. They have developed a program called the DCYC Green Boating Initiative that encourages its members to be environmentally aware and friendly in their enjoyment of recreational boating, fishing and sailing. They were recently awarded a grant from the Boat/U.S. Foundation for Boating Safety & Clean Water to continue the program that began last year. Bill Woodroffe, Commodore of the club, was very pleased that they received the funding which will be used to purchase boat decals and print pledge forms and other environmental information for the boaters. "As users of this great recreational asset in Jamaica Bay, boaters see first hand the stress the bay is under. It is surrounded by 2 million people in an urban and industrialized environment. As a boater I believe we can and should treat these waters as a great recreational asset and still respect the environment. Otherwise we will see more fences and walls preventing any access to the bay. Boaters are not nearly the major contributing factors stressing the bay but we all must do our part in being environmentally aware and friendly." The club boaters who sign on to the DCYC Green Boating Initiative agree to ten specific steps they will take to keep the waters cleaner. These include using less toxic cleaning products, keeping oil and wastes out of the water, using marine pump-out stations, recycling and other steps that are environmentally friendly. By placing the bright green and yellow initiative decal on their boats they hope to spread the word about green boating to others on the water. Gateway Marina, a concession within the National Recreation Area, is cooperating with the club's initiative by offering discounts for pump-out services for participating members. "I would like to see others get involved in practical and positive steps to protect this great bay," said Bill Woodroffe, "And I not only mean the boaters but other users, businesses and even government installations that line the shoreline and affect the bay much more than individual boaters. We are, in the end, all in the same boat!" The Deep Creek Yacht Club, formed in 1959, has one of the largest number of active boating members in the area and works closely with the National Park Service in such things as public sailing programs and boat restoration. Commodore Woodroffe commented that "the marina location within the National Recreation Area is ideally suited for these activities and we feel that we are helping to fulfill the National Parks objectives for this terrific asset".


PFDs for children under 13
Logo WASHINGTON, DC-Effective this March 29, 2002 the new Coast Guard regulations on the use of Personal Flotation Devices (PFDs) by recreational boaters will go into effect. Although the Coast Guard has long required all recreational vessels in US waters to carry PFDs, these changes mandate that any child under the age of 13 be wearing a Coast Guard-approved life saving device under most circumstances. Although 31 states already have laws requiring children of various ages to wear a PFD, there has been no such requirement at the federal level. The new rules, which will directly affect recreational boaters in the 19 states without any such regulations, exempt children from wearing a PFD only if the child is below decks or inside an enclosed cabin, or if the boat is not underway. For those states that have already enacted requirements concerning the use of PFDs by children, the new Coast Guard regulation specifically leaves the state laws in place. That means, for instance, that in many states these regulations may apply to individuals up to the age of 18 or be influenced by the size of the boat. Between 1995 and 1998, 105 children under the age of 13 died in the water, 66 of them by drowning. The number of children drowned in boating-related accidents has been steadily decreasing with 26 cases reported in 1995 and only 11 in 1998.

NAVAL VESSEL PROTECTION ZONES
The U.S. Coast Guard has established Protection Zones for a distance of 500 yards around all U.S. naval vessels in navigable waters of the United States. Vessels are to proceed at a no-wake speed when within a Protection Zone. Non-military vessels are not allowed to enter within 100 yards of a U.S. naval vessel, whether underway or moored, unless authorized by an official patrol. The patrol may be either USCG or USN. A U.S. naval vessel is any vessel owned, operated, chartered, or leased by the U.S. Navy and any vessel under the operational control of the U.S. Navy or a Unified Commander. These protection zones will remain in effect through June 15, 2002 and are subject to change without prior notice. Click here to see warning

    HOFFMAN AND SWINBURNE ISLANDS

    Staten Island, NY

    Hoffman and Swinburne Islands were constructed in 1872 to serve as a quarantine station and crematorium for immigrants entering the United States. Named for NYC Mayor John Hoffman and Civil War Army surgeon Dr. John Swinburne, the islands were formed from dredged sand in the 1860s. Hoffman Island's history goes back to 1872 when she was constructed by the City of New York to house a quarantine station. The name was taken from Governor J. T. Hoffman and the island handled the greatest immigration wave in our country's history before it was abandoned and later used to store Navy equipment after the First World War. It served as a harbor defense unit during that war. An outbreak of parrot fever along the coast at one time turned Hoffman Island into an isolation station for parrots instead of immigrants. In 1937 the island served still another purpose when underprivileged children from New York were brought out every Sunday throughout the summer for recreation. On September 7, 1938, she went through another transformation. She became the home for the first U. S. Maritime Service Training Station. The old quarantine delousing plant became a boat shed, the largest and oldest of the quarantine barracks was turned into a gymnasium and other buildings were made into classrooms, barracks and mess halls. A new school building was constructed in 1940 and a sick bay, additional barracks and a gun shed were put up. The entire base gave more the appearance of a cozy New England town than a training station Under the administration of the National Park Service since 1974, these islands have become nesting sanctuaries for many native bird species. The islands are not open to the public.


    Tax-Time Tip from BoatU.S.: Boats Qualify as Second Home February 1, 2001 - As the 2004 income tax return filing deadline approaches, boat owners should remember that interest paid on a secured boat loan is tax-deductible as long as the boat meets the Internal Revenue Service (IRS) criteria for a second home, said the 515,000-member Boat Owners Association of The United States (BoatU.S.) "For tax purposes, many boats are used and qualify as second homes just like land-based vacation condos and mobile homes," said Elaine Dickinson of BoatU.S. Government Affairs. The IRS defines a second home as having "basic living accommodations such as sleeping space, toilet and cooking facilities." A secured loan is one where a lending institution holds the boat as collateral for the loan. Interest paid on the loan should be reported on the federal income tax return Form 1040, Schedule A, Itemized Deductions. Boat owners who received a 1098 form from their bank should enter the amount of interest paid on line 10. If they did not receive a 1098 form, they should enter the amount on line 11 and provide the lender's name, address and tax identification number.
